Welcome to Saturday!
Thanks for using the Saturday services (including its website, and mobile and web-based applications, and any other tools, products, or services provided by FOMO Ventures that link to or reference these Terms) (collectively, the “Services”). The Services are provided by FOMO Ventures, Inc. (“FOMO Ventures”, “we,” “our,” or “us”), with an address of 16 Middle Neck Rd # 2075, Great Neck, NY 11021, U.S.A.
By using our Services, you are agreeing to these Terms of Service (“Terms”). Please read them carefully. Our Services are very diverse, so sometimes additional terms or product requirements (including age requirements) may apply. If additional terms or conditions are available with or applicable to the relevant Services, then those additional terms become part of your agreement with us if you use those Services. By accessing or using the Services, you intend and agree to be legally bound by these Terms. You may wish to print or save a local copy of the Terms for your records.
YOU ACKNOWLEDGE AND AGREE THAT THESE TERMS OF SERVICE LIMIT OUR LIABILITY AND THAT YOU ARE RELEASING US FROM VARIOUS CLAIMS IN SECTION 9 BELOW. THESE TERMS ALSO CONTAIN A BINDING ARBITRATION PROVISION IN SECTION 15 THAT AFFECT YOUR RIGHTS UNDER THESE TERMS WITH RESPECT TO THE SERVICES.
You must follow any policies made available to you within the Services.
We do not authorize users under 17 years of age to use the Services.
Don’t misuse our Services. For example, don’t interfere with our Services, try to access them using a method other than the interface and the instructions that we provide, or extensively or automatically copy any content from the Services (in other words, no scraping). You may use our Services only for your personal non-commercial use, and as permitted by law, including applicable export and re-export control laws and regulations. We may suspend or stop providing our Services to you if you do not comply with our terms or policies, if we are investigating suspected misconduct, or for any other reason.
Using our Services does not give you ownership of any intellectual property rights in our Services or the content you access through them (“Content”). You may not use Content, except as permitted in these Terms, by its owner, or as otherwise permitted by law. These Terms do not grant you the right to use any branding or logos used in our Services, including the Saturday and FOMO Ventures names and logos. Don’t remove, obscure, or alter any legal notices displayed in or along with our Services.
Our Services display some Content that is not our own. For example, Content belonging to our advertisers, other third parties, you, or other users (collectively, “Third Party Content”). We are not responsible for, and you waive all of our liability with respect to, Third Party Content. Third Party Content is the sole responsibility of the individual or entity that makes it available to you via the Services. We may review Third Party Content to determine whether it is illegal or violates our policies, and we may remove or refuse to display Third Party Content that we believe violates our policies or the law. But we do not generally review content beforehand, and we are not obligated to do so.
Certain features of the Services are only available to users that have achieved certain milestones or levels of engagement on the Services (“Special Features”), such as number of followers or activities, as determined by us in our sole discretion. We may add or remove Special Features, and we may suspend or stop providing Special Features altogether, at any time, without any notice or liability.
Communications and Text Messages.
In connection with your use of the Services, we may send you service announcements, administrative messages, and other information. You may opt out of our marketing emails by clicking on the “unsubscribe” link in marketing e-mails or texting “Stop” or “Do Not Send” in response to text messages or disabling notifications in the Services’ settings. Please be aware that there may be a brief period before we are able to process your opt-out. You can disable push notifications from the “Settings” page.
Some of our Services are available on mobile devices or may utilize SMS/iMessage. For example, the Services may send text messages to your mobile device in order to verify and pair your mobile device with your Services account. We may also send you SMS/iMessage messages for transactional, operational, or informational purposes. Your voluntary provision to us of your phone number represents your consent for us to contact you by SMS/iMessage for each of these purposes, and your consent to receiving such communications for these purposes, as further described in our Privacy Policy. Please be aware that utilizing the mobile or SMS/iMessage features of the Services may cause you to incur SMS or data charges with your wireless provider – we have no control over these charges, and if you do not wish to be charged, you should stop using the mobile or SMS/iMessage features (as applicable). You can unsubscribe from and stop receiving SMS/iMessage messages from us as described in our Privacy Policy.
The Services may allow you to initiate SMS/iMessage messages to your friends, family, or other contacts to invite them to use the Services. If you choose to invite others to the Services using SMS/iMessage messages, we may suggest content for the message, which you may edit and customize before you initiate the message. When you send SMS/iMessage messages using the Services, you represent and warrant you have the recipient’s prior consent to send him or her messages.
